South Carolina recognizes five different grounds for divorce, including four fault-based grounds: Adultery, Physical Cruelty, Abandonment, and Habitual Drunkenness. Additionally, there is a no-fault ground of One Year's Continuous Separation or what some refer to as a one-year trial separation. Another cause of action in South Carolina is Separate Support and Maintenance.

In South Carolina, you cannot file for divorce unless you can allege a fault-based ground, or you have already been separated for more than one year. The action of Separate Support and Maintenance allows individuals to seek temporary and final distribution of their assets, child custody and visitation arrangements, and temporary or permanent spousal support, all while being separated. These actions enable parties to resolve all issues of their marriage except for the actual divorce itself.

Other family law cases we handle in the Low Country include custody, visitation, and support modifications or establishment. In South Carolina, we can typically modify an existing order that involves a minor child, such as child support, custody, and visitation, as long as there has been a substantial and material change in circumstances.
